Dispute Resolution and Arbitration

Informal Resolution

Before filing any formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally. Both parties agree to make a good-faith effort to resolve the matter within a reasonable timeframe before initiating arbitration or court proceedings.

Small Claims Option

For disputes where the total amount in controversy is less than $10,000 USD, either party may elect to resolve the dispute in the appropriate small claims court located in Gwinnett County, Georgia, provided the claim qualifies for small claims jurisdiction.

Binding Arbitration

For any dispute, claim, or controversy arising out of or relating to these Terms or your use of ScratchCheck that exceeds $10,000 USD, the dispute shall be resolved exclusively through binding arbitration administered by New Era ADR in accordance with its Expedited Virtual Arbitration Rules and Procedures, conducted entirely online.

The arbitration shall be conducted virtually, with no in-person appearance required, unless otherwise agreed by the parties or required by the arbitrator. Judgment on the arbitration award may be entered in any court having jurisdiction. New Era ADR's rules and fee schedule are available at neweraadr.com.

Individual Proceedings Only

You agree that any arbitration or court proceeding shall be conducted on an individual basis only and not as part of a class, consolidated, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Injunctive Relief

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction located in Gwinnett County, Georgia, for claims involving intellectual property, unauthorized access, misuse of proprietary data, or violation of user conduct provisions.

Improperly Filed Claims

Any claim filed in a manner inconsistent with this Dispute Resolution section may be subject to dismissal or referral to the appropriate forum. The prevailing party in enforcing this provision may seek reasonable costs and fees to the extent permitted by applicable law.

Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full force and effect.

Termination

We reserve the right to suspend or terminate access to ScratchCheck at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to the Site, its users, or 7H Ventures LLC.

Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and 7H Ventures LLC with respect to your use of ScratchCheck.

Copyright Policy (DMCA)

7H Ventures LLC respects the intellectual property rights of others and expects users of ScratchCheck to do the same. We comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) and will respond to valid notices of alleged copyright infringement.

Submitting a Takedown Notice

If you believe that content available on ScratchCheck infringes your copyright, you may submit a written notification to our designated agent. To be valid under the DMCA, your notice must include all of the following:

  • Identification of the material claimed to be infringing, with sufficient information to locate it on the Site (e.g., a URL)
  • Your name, mailing address, telephone number, and email address
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner

Submitting a false or fraudulent DMCA notice may expose you to liability under 17 U.S.C. § 512(f), including damages, costs, and attorney's fees.

Counter-Notice

If you believe content was removed from ScratchCheck in error or as a result of misidentification, you may submit a counter-notice to our designated agent. A valid counter-notice must include:

  • Your physical or electronic signature

Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant files a court action.

Repeat Infringer Policy

In accordance with the DMCA and applicable law, 7H Ventures LLC maintains a policy of terminating, in appropriate circumstances, the accounts or access of users who are determined to be repeat infringers of copyright.
